Function of MDY Legal

 

MDY Legal is a multidisciplinary law firm providing legal advisory and programme management services with a focus on international development and social investment.

 

MDY Legal provides legal services to a number of key clients and programme management services to two high profile international development programmes funded by international aid agencies in the infrastructure and health sectors (PIDG www.pidg.org and HANSHEP www.hanshep.org).

 

 

 

Main Purpose of Role

The post holder will be a key member of the Firm’s Procurement Practice and will be responsible for advising on, managing and coordinating procurement and contracting processes for MDY Legal and its clients and programmes.

 

 

Main Responsibilities of Job

The Procurement Lawyer will be responsible for:

 

  • acting as first point of contact for clients on procurement either (i) on the procurer/purchaser side or (ii) on the tenderer/supplier side of procurement processes / transactions;

 

  • acting as a first point of contact for clients on standard contract (e.g. Services Contracts) or liaison with other specialist Contract Lawyers  where necessary (e.g. IT Contracts, Fund Management Contracts, Works Contracts etc); 
    • negotiating the legal terms of proposed transactions or arrangements with solicitors acting for the counter-parties to such transactions or arrangements (or occasionally directly with the counter-parties themselves);

 

  • assisting MDY Legal to bid for and undertake assignments in various competitive tendering scenarios and generally maximise the opportunities provided by MDY Legal’s inclusion on the Crown Commercial Services (CCS) framework panel (General Commercial Lot 6) and more generally;

 

  • drafting of/assisting with the preparation of pre-contract and contract documentation, including OJEU Contract Notices, Pre-Qualification Questionnaires, invitations to tender, requests for proposals, clarifications, adverts, correspondence etc in accordance with the Programmes’ policies and procedures (including, where applicable, the UK Public Contracts Regulations);

 

  • reviewing draft terms of reference prepared by project managers to assess requirements and deliverables and to highlight areas of risk such as ambiguities and conflicts and drafting contractual measures to mitigate such risks such as conditions precedent, milestone payments, liquidated damages, performance guarantees etc.;

 

  • overseeing the publication of contracts and/or summaries of them in appropriate places as required by the Programmes;

 

  • as needed, providing guidance on contract matters to project managers or other operational staff, including training to new project managers and other employees in contracting practices and procedures and contract management;

 

  • contributing to MDY Legal’s business development initiatives by writing articles about changes in Procurement Law, networking and generally seeking appropriate advisory, transactional and consulting opportunities in the Procurement sphere.

 

Skills and Experience

  • A minimum of 5-8 years Post Qualification Experience of providing legal advice in relation to procurement law for private and public sector clients.
  • Experience of public procurement of goods, services and works including end to end operational procurement experience.
  • Excellent oral and written communication skills
  • Excellent computer skills
  • Expert analytical skills
  • Ability to tackle difficult problems and devise solutions
  • Ability to balance meeting the clients’ operational/transactional requirements with ensuring availability to support other colleagues ad hoc procurement queries and needs
  • Occasional overseas travel may be required
  • Interest in the international development sector desirable

Educational Qualifications

  • Graduate or a Masters degree in law, or equivalent experience.
  • Solicitor
